16.08.040 Filing, approval procedure.

A. Four copies of the application packet shall be filed with the plat officer, one of which is filed with the village clerk and the remaining three submitted to the planning commission. One of these four copies shall be reviewed by the village engineer, who shall give either a written or oral report to the planning commission on the subdivision proposal prior to the holding of a public hearing.
B. The planning commission shall hold a public hearing and make a recommendation to the village board for approval or disapproval of the preliminary plat within ninety days of the filing date of the application or the filing of the last item of support data, whichever date is later, unless such time is extended by mutual consent.
C. If the recommendation is for disapproval, the planning commission shall state the reasons for its recommendation by citing precisely how the preliminary plat, proposed subdivision or support data do not meet the provisions of this title or fail to comply with the official map. The subdivider may revise the preliminary plat in order to resubmit it for approval without paying the filing fee again. If the preliminary plat is disapproved, within the same ninety days the planning commission shall furnish to the applicant subdivider, in writing, a statement setting forth the reasons for disapproval. The planning commission’s recommendation shall be in the form of a resolution passed by a majority vote of the commission membership, so stating the recommendation including the reasoning, and transmittal to the village board by letter signed by the chairperson or designee within five working days of the hearing, both resolution and letter attached to a copy of the preliminary plat.
D. The village board shall have thirty days after its next regularly scheduled meeting following the planning commission’s recommendation to approve or disapprove the plat. If the village board approves the plat, the subdivider may proceed with preparing the final plat for submittal. If the plat is disapproved, the subdivider may make the changes in the plat as directed by the village board and resubmit the revised plat for approval. It shall be at the discretion of the board whether to require the subdivider to follow the complete preliminary plat submittal process again when making changes in the plat, or whether the revised preliminary plat may be simply resubmitted to the board.
E. When the village board has approved the preliminary plat, the original plat and one reproducible (Mylar) plat shall be endorsed by the village president. The original shall be returned to the subdivider or his or her representative and the endorsed reproducible plat shall be filed with the village clerk. Approval of the preliminary plat does not qualify it for recording. The endorsed plat authorizes the subdivider to proceed with the final plat. (Subdivision Ordinance dated 6/3/03 § 2-4)
