Chapter 13.45 MINIMUM AND MAXIMUM SETBACK ZONES FOR PROTECTION OF WATER WELLS
13.45.010 Purpose.
Pursuant to the authority conferred by 65 ILCS 5/11-125-4;
415 ILCS 5/14.2 and 5/14.3; 65 ILCS 5/7-4-2 and in the interest of securing the
public health, safety and welfare; to preserve the quality and quantity of
groundwater resources in order to assure a safe and adequate water supply for
present and future generations; and to preserve groundwater resources currently
in use and those aquifers having a potential for future use as a public water
supply, the provisions of this chapter shall apply to all properties located
within the minimum setback zone established under Section 14.2 of the Act (415
ILCS 5/14.2 and this chapter, and the maximum setback zone established under
Section 14.3 of the Act (415 ILCS 5/14.3) and this chapter.
Pursuant to the authority conferred by 65 ILCS 5/7-4-2, all
property which (1) is owned by a municipality, and (2) lies outside the
corporate limits of the municipality, and (3) does not lie within the corporate
limits of any municipality, shall be subject to the ordinances, control and
jurisdiction of the municipality in all respects the same as the property owned
by the municipality which lies within the corporate limits thereof. (Ord. 1995-3
