Chapter 9.08 CURFEW HOURS FOR MINORS
9.08.030 Exceptions.
A. A minor does not commit an offense under Section
9.08.020(A) if the minor was:
1. Accompanied by the minor’s parent or guardian or
other responsible companion at least eighteen years of age approved by the
parent or guardian;
2. In a motor vehicle involved in interstate
travel;
3. Engaged in an employment activity, or going to or
returning home from an employment activity, without any detour or
stop;
4. Involved in an emergency;
5. Attending an official school, religious, or other
recreational activity supervised by adults and sponsored by the village, a civic
organization, or another similar entity that takes responsibility for the minor,
or going to or returning home from, without any detour or stop, an official
school, religious, or other recreational activity supervised by adults and
sponsored by the village, a civic organization, or another similar entity that
takes responsibility for the minor;
6. Exercising First Amendment rights protected by the United
States Constitution, such as the free exercise of religion, freedom of speech,
and the right of assembly; or
7. Married or had been married or is an emancipated minor
under Emancipation of Mature Minors Act, as amended.
B. A parent or guardian of a minor does not commit an offense
under Section 9.08.020(B) if any exception in subsection A of this section
applies.
C. An owner, operator, or employee of an establishment does
not commit an offense under Section 9.08.020(C) if he or she promptly notified
the police department that a minor was present on the premises of the
establishment during curfew hours and refused to leave or if any exception in
subsection A of this section applies. (Ord. 2004-6 § 1 (part),
