Chapter 6.04 GENERAL PROVISIONS
6.04.020 Definitions.
As used in this title, the following words and phrases shall
have the meanings respectively ascribed to them in this section.
A. "Animal" means any and all types of animals, both
domesticated and wild, male and female, singular and plural.
B. "At large" means off the premises of the owner and not
under the immediate control of either the owner or a person the owner has
designated to be in control. If an animal under the control of a village
official or veterinarian escapes and runs loose, however, it shall not be
considered "at large."
C. "Bite" means the infliction of a break in the skin or a
wound by the teeth of an animal.
D. "Cruelty to animals" shall include, but not necessarily be
limited to, the following:
1. Overloading, overdriving, overworking, beating, torturing,
abusing, tormenting, knowingly poisoning, knowingly attempting to poison,
mutilating or killing any animal, or causing or knowingly permitting the same to
be done;
2. Unnecessarily failing to provide an animal in one’s
charge or custody as owner or otherwise with proper food, drink and sanitary
shelter;
3. Abandoning any animal by leaving such animal on any
highway or public way or in any other place where it may suffer injury, hunger,
exposure or become a public charge.
E. "Dog" means any animal of the canine species.
F. "Owner" means any person owning, harboring or keeping an
animal within the village. A person harboring or keeping an unlicensed animal in
the village for a period of five days shall be presumed to be the owner of the
animal. For the purposes of this title, the person last issued a dog license
shall be presumed to be the owner of the dog. (Ord. 1978-7 § 1-2,
